Eligibility Users must be 18 years or older to use our services. By accessing our services, you confirm that you satisfy the age requirement and have the legal authority to accept this Agreement. ### 1.4. Browser Requirements A compatible web browser is required to access the Website. You understand that Audify AI may discontinue support for certain browsers, which could necessitate updating your browser to continue using the services. ## 2. Payments and Charges ### 2.1. Accepted Payment Methods Audify AI accepts payments through Visa and MasterCard. By providing your payment details, you verify that you have the authority to use the selected payment method and authorize us to charge the required amount. ### 2.2. Subscription Plans Audify AI offers various subscription plans with different usage limits and features. Details of each plan, including pricing and included features, are available on our pricing page. ### 2.3. Authorization You grant Audify AI permission to charge your chosen payment method for the full amount of your purchase, including any relevant fees. For subscription plans, you authorize recurring charges at the applicable billing interval until you cancel. ## 3. Refund Policy ### 3.1. Requesting a Refund You can request a refund within 14 days of purchase if the service was not delivered as described, experienced significant technical issues, or did not meet the agreed-upon standards. Refund requests can be submitted via email to support@audifyai.com. ### 3.2. Refund Eligibility Refunds will be considered for eligible requests made within the 14-day period. Credits or tokens that have already been consumed are not eligible for a refund. ### 3.3. Cancellation Consequences After canceling and receiving a refund, you will lose access to your subscription plan and any unused credits. Generated audio content that has already been downloaded remains yours to keep. ## 4. Service Delivery ### 4.1. Delivery Timeline Audio generation is typically processed within seconds to minutes, depending on the length and complexity of the content. In rare cases, processing may take longer due to high server demand. ### 4.2. Service Availability While we strive for 99.9% uptime, Audify AI does not guarantee uninterrupted access to the service. Scheduled maintenance and unforeseen technical issues may temporarily affect availability. Users will be notified of planned maintenance in advance whenever possible. ## 5. Use of Services ### 5.1. Acceptable Use Audify AI services are available to both individuals and businesses. You agree not to use the services to: - Generate audio content that is defamatory, obscene, or promotes violence or hatred - Impersonate real individuals without their explicit consent - Create deepfake audio for fraudulent or deceptive purposes - Violate any applicable laws or third-party rights - Circumvent usage limits or abuse the platform ### 5.2. Generated Content Audio content generated through Audify AI may be used for personal and commercial purposes in accordance with your subscription plan. You are solely responsible for ensuring your use of generated content complies with all applicable laws. ## 6. Pricing ### 6.1. Service Costs The price of services depends on the subscription plan selected. Usage-based pricing may apply for certain features or overages. ### 6.2. Price Adjustments Audify AI reserves the right to modify subscription prices. Existing subscribers will be given at least 30 days notice before any price changes take effect on their next billing cycle. ## 7. Intellectual Property ### 7.1. Platform Content All materials on the Website, including text, images, graphics, logos, software, and AI models, are the property of Keyvenor OÜ or its licensors and are protected by international copyright and intellectual property laws. ### 7.2. User-Generated Content You retain ownership of the text content you submit for audio generation. By using the service, you grant Audify AI a limited license to process your content solely for the purpose of providing the service. We do not claim ownership of your input text or generated audio. ## 8. Governing Law and Jurisdiction ### 8.1. Applicable Law These terms are governed by the laws of the Republic of Estonia and will be interpreted in accordance with them. ### 8.2. Dispute Resolution We aim to resolve disputes fairly and efficiently. If you have a complaint, please contact our support team at support@audifyai.com. Unresolved issues can be escalated by submitting a formal dispute with detailed information and supporting evidence. Once a formal dispute is submitted, we will review it thoroughly and provide a response within 30 days. If no resolution is reached, disputes will be handled exclusively by the courts of Harju County, Estonia. By using this website, you agree to this process and jurisdiction. ## 9. Limitation of Liability ### 9.1. No Guarantees Audify AI presents the Website and its services on an "as is" and "as available" basis, without offering any warranties, either express or implied. We disclaim all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. ### 9.2. Limitation of Liability To the maximum extent allowed by law, Keyvenor OÜ, its directors, employees, or agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, usage, goodwill, or other intangible losses, resulting from (i) your inability to access the service; (ii) unauthorized access to our servers; (iii) any service interruptions; (iv) bugs, viruses, or other harmful issues; (v) errors or omissions in generated content; or (vi) illegal, offensive, or harmful actions by third parties. ## 10. Indemnification You agree to protect, defend, and hold Keyvenor OÜ, its affiliates, officers, directors, employees, and agents harmless from any claims, damages, losses, costs, or expenses (including legal fees) arising from (i) your use of the Website and services; (ii) your violation of these terms; (iii) any infringement of third-party rights; or (iv) any claims that your use of the services has caused harm to others. ## 11. Account Termination ### 11.1. Right to Terminate Audify AI may suspend or terminate your account and access to the Website at its discretion, with or without prior notice, if your actions breach these terms, cause harm to other users, the Company, or third parties, or for any other reasonable cause. ### 11.2. Consequences of Termination Once your account is terminated, your access to the Website and services will be immediately revoked. Any unused credits or subscription time will be forfeited. If you wish to terminate your account, you may do so through your account settings or by contacting support. ## 12. No Waiver If Audify AI fails to enforce any part of these terms, it will not be considered a waiver of those rights. Any waiver of these terms will be valid only if documented in writing and signed by an authorized representative of Keyvenor OÜ. ## 13. Miscellaneous ### 13.1. Complete Agreement These terms represent the complete agreement between you and Keyvenor OÜ concerning your use of the Website and services, superseding any prior agreements. ### 13.2. Severability If any portion of these terms is deemed invalid or unenforceable, the remaining provisions will remain in full force and effect. ### 13.3. Force Majeure Keyvenor OÜ will not be responsible for any delays or failures in performance due to events beyond its reasonable control, including but not limited to natural disasters, war, terrorism, government actions, fires, floods, pandemics, strikes, or shortages in resources. ## 14. Modification of Terms Audify AI reserves the right to update these terms at any time by posting the revised terms on the Website. Your continued use of the Website after any changes indicates your acceptance of the new terms.
